Deposit and Payments:
A 50% deposit or full payment is required to reserve customer's trip date(s). Balance is due 21 days prior to departure date. If customer registers after the balance due date, full payment is required.
If, for any reason we do not receive customer's entire payment on or before the balance due date, we reserve the right to treat the customer's reservation as a cancellation with complete forfeiture of any deposit.

Cancellation and Refund Policy:
If customer must cancel the scheduled trip for any reason, including medical, the following refund policy applies without exception: Cancellations made 21 days prior to trip departure date ensures customer a full refund, less a $25.00 processing fee. There is no refund, however, for cancellations made within 21 days of the start of the trip. Moreover, customer may be liable for Sierra Sherpa's out of pocket expenses incurred in preparation for trip which exceed customer's deposit.
By acceptance of customer's deposit, Sierra Sherpa agrees to reserve customer's trip date(s) to the exclusion of all others. However, contingencies beyond Sierra Sherpa's control may occur which would require Sierra Sherpa to cancel the trip, including but not limited to, dangerous weather conditions. In the event that Sierra Sherpa must cancel a trip, customer will be entitled to a full refund.
However, Sierra Sherpa is not responsible for additional expenses incurred by customer in anticipation of a trip, including but not limited to, nonrefundable airline tickets, car and/or equipment rental, etc. We recommend that customer obtain trip cancellation insurance for protection.
Release and Assumption of Risks:
Customer is aware that during the ski tour, course, mountain trip, or any other activity or program that customer is participating under the arrangement of Sierra Sherpa, certain risks and dangers exist, including, but not limited to, travel by air, automobile, or other conveyance, travel in mountainous terrain, the forces of nature, accident, injury, illness, paralysis, or death in remote places without rapid means of evacuation or medical facilities.
In consideration of, and as part payment for, the right to participate in such course, mountain trip or activities, services and food arranged for customer by Sierra Sherpa, it's instructors, guides, agents, employees, and associates, customer has and here by assumes all of the above risks and will hold them harmless from any and all responsibility, negligence, actions, or suits of any kind or any nature whatsoever for loss or damage to property or personal injuries sustained or occurring during any course, guided trip, or activity of any nature.
This agreement shall serve as a release and assumption of risk for customer, his/her heirs, administrators, executors, and for all others claiming to act on customer's behalf. This release shall further extend to all members of the customer's family, including minors, who may be accompanying customer and who, by virtue of their age, are not required to enter into this agreement on their own behalf.
Sierra Sherpa does not provide storage, theft, or damage protection of personal property and/or valuables during it's scheduled trip(s). Use discretion when selecting gear and storing options.
Conduct and Expulsion:
Sierra Sherpa expects that all participants will conduct themselves in a safe and responsible manner. A customer who, through misconduct or unsafe behavior, pose a danger to themselves or others may be asked to leave a trip or activity and find alternate return transportation at their own expense. Removal from an activity in progress will result in forfeiture of all fees paid.
Governing Law:
This agreement shall be governed by, construed and enforced in accordance with the laws of the state of California.
Severability:
In the event that any provision contained herein is deemed to be invalid or void by any court of competent jurisdiction, the same shall be deemed severable from the remainder of this agreement, and shall in no way affect any other provision contained herein.
Waiver and Amendment:
No breach of any provision contained herein can be waived unless in writing. Waiver of any one breach shall not be deemed to be a waiver of any other breach of the same or any other provision hereof. This agreement may be amended only by another written agreement executed by the parties at the time of the modification.
Individual and Corporate Authority:
Any individual signing this agreement on behalf of another individual, including minors, a corporation, partnership or other business entity, represents or warrants that he or she has full authority to do so.
Voluntary Agreement:
The parties here to, and each of them, further represent and declare that they have carefully read this agreement and know the contents thereof and that they have signed the same freely and voluntarily.
Costs and Attorney's Fees:
The parties, and each of them, agree that if they or any of them, hereafter file a lawsuit or assert a defense, claim, counter-claim or cross-claim, arising out of, based upon, or relating to the matters covered by this agreement and release or any provision, term or covenant contained in this agreement, the prevailing party in such suit or action shall be entitled to receive, in addition to any compensation for any other damages sustained, any and all reasonable attorneys' fees and costs incurred by the party in litigating, defending, or otherwise responding to such a suit or action.
Venue:
Placer County shall be the proper venue to enforce the provisions of this agreement.

All trips offered by Sierra Sherpa are custom tailored to meet the individual and group needs in a variety of locations throughout the Sierra Nevada backcountry. Although we offer instruction, we recommend that anyone wishing to utilize Sierra Sherpa have some experience in either skiing, camping or related activities. It is important to note that services offered by Sierra Sherpa may not be suitable for some. Therefore, we reserve the right to reject an application if the applicant does not have the prerequisite experience or skill.
